GOODRICH, CITY ATTORNEY <br /> <br />CABLE TV ORDINANCE-FRANCHISE <br /> <br />APRIL 21, 1982 <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />As you are aware, the above subject is on the Council's April <br />27, 1982 meeting agenda. As requested by the City <br />Administrator, I have reviewed the Ordinance-Franchise and <br />present the following for your information. <br /> <br />The document contained in the Council Agenda entitled "Final <br />Franchise, Ramsey, Minnesota" is actually the contract with <br />Telepromter and the Ordinance regulating the Franchise within the <br />City. As you will note, this is an 86 page document which <br />contains much technical language relating to construction and <br />day-to-day operation of the system. This memo is not intended to <br />review or comment on that language, as it has been extensively <br />reviewed and redrafted by the Cable TV Commission and their <br />attorney. The purpose of this memo is to advise the Council of <br />the legal mechanics contained in the Ordinance-Franchise. <br /> <br />Since this is an Ordinance, it will be Ramsey's law <br />relating to the Cable TV Franchise operation. <br /> <br />The Ordinance does reference Teleprompter's offering which <br />also is a part of the Ordinance-Franchise. Any <br />discrepancies between the Ordinance and the offering will <br />be decided by that provision which is most beneficial to <br />the City. <br /> <br />I <br />I <br /> <br />e <br /> <br />Please review the Institutional Network section on pages 19 <br />and 20 to make certain this meets Ramsey's needs. <br /> <br />Upon passage of the Ordinance, Ramsey will receive $14,000 <br />to defray its expenses for its costs and expenses in <br />developing the Franchise, adopting the Ordinance, etc. <br /> <br />I 5. <br /> <br />During the Franchise operation, Ramsey will receive 5% of <br />the Company's gross revenues, which money is to be used for <br />Cable TV related items. It appears that the Council will <br />have a rather large latitude in the use of these funds. <br /> <br />The term of the Franchise will be 15 years from the date of <br />the Ordinance. The City can then take over the system, get <br />a new operator or renegotiate with Teleprompter at that <br />time. <br /> <br /> <br />
