Within 90 days after <br />obtaining the permits, the Company will need to start <br />construction. The system will need to be completed within <br />one year from wben the State Certification is given, which <br />will be on approximately May 1, 1982, so construction will <br />be completed by about May 1, 1983. <br /> <br />The Company will use City streets and easements for line <br />construction and will need to obtain necessary permits from <br />the City and restore property as any other utility. <br /> <br />Where other utilities are undergrqund, the cable will be <br />underground. Where others are aboge ground, the cable will <br />be above ground and will, therefore, rent space from the <br />telephone company, etc. <br /> <br />The terms "Tier I, Tier II and Tier III" refer to the <br />number of stations a subscriber opts to purchmse, from 25 <br />to 52 stations. "Tier" does not refer to the geographical <br />area of the City served. <br /> <br />The Ordinance requires the entire City to be served by the <br />trunk cable within one year. Where dwelling units exceed a <br />density of 40 homes per square mile, service will be <br />available to all such areas. Where there is not a density <br />of 40 homes per square mile, the subscriber will be given a <br />$400 credit on line extension to his home and he or <br />neighbors also subscribing will have to pay the balance of <br />the construction cost. When other homes are built on the <br />line, the residents who paid for its construction will be <br />given back their construction cost on the basis of $400 per <br />new home built. <br /> <br />For service drops which exceed 200 feet from the trunk, the <br />subscriber will have to pay the Company's construction cost <br />beyond 200 feet. <br /> <br />The Company will indemnify the City from claims, damages, <br />etc. relating to the Franchise. The Company will maintain <br />a $500,000/$2,000,000 property damage policy and a <br />$1,000,000/$2,000,00p personal injurY policy. The Company <br />will also provide a $10,000 letter of credit to be used for <br />penalties and failure of the Company to pay sums it might <br />owe to the City. This sum may also be used at the rate of <br />$500 per day if the Company fails to get the system <br /> <br /> <br />
