Creighton, Legal Counsel <br />North Suburban Cable Commission <br /> <br />Preliminary Franchise Ordinance <br /> <br /> Please find enclosed the Preliminary Franchise proposed for <br />the Cable Con~ission. As you know, last summer your con,unity <br />entered into a joint powers agreement forming the Commission. <br />The general purpose of this organization was to develop a request <br />for proposals and a preliminary franchise to be issued on behalf <br />of your city for the purpose of developing a cable communication <br />system for the four-city areA. The Commission hopes to issue <br />the request for proposals in April. Approximately 90 days later <br />the cable companies will present to the Commission and the member <br />cities their proposals for the development of a cable system in <br />the four-city area. The proposals will be evaluated, and the <br />Commission will select a successful proposal to be recommended <br />back to the cities along With a final proposed franchise ordi- <br />nance which it is hoped will be adopted through the regular <br />ordinance' procedures of each individual city. It is important <br />to note that the entire Commission has been structured to keep <br />the franchising authority with each individual community. <br />Because this will become an ordinance of your city, I am forward- <br />ing the Preliminary Franchise to you for your review. It is <br />hoped that you will not only familiarize yourself generally with <br />the basic ordinance, but review it at this time from the per- <br />spective of your individual city. If, for instance, such things <br />as the definition of "street" would cause any problems with your <br />individual city, it is imperative that such a discrepancy be <br />worked out among the city attorneys early in the process. <br /> <br /> The cable franchising process is regulated both to a minor <br />degree by the F.C.C. and considerably by the Minnesota State <br />Cable Communications Board through their Communications Board <br />Rules (4 MCAR ~4.001-4.231). These rules contain extensive <br />minimum franchise standards. A cable televfsion system may not <br />be granted a Certificate of Confirmation which permits system <br /> <br /> <br />
