As a result, .a number of the sections of the enclosed Preliminary Franchise owe their excess verbosity to the state minimum franchis(3 requirements. It should be noted that the Preliminary I?ranchise is modeled verbatim in a number of sections after thc Southwest Suburban Cable F'ranchise which )]as received appr()val from the State Cable Board. The Southwest Franchise was the product of many, many drafts from numerous meetings of the Southwest Cable Commission attorney and the city attorneys from the southwest area. Hope- fully, we can benefit from this legal work which )las gone before us and save ourselves numerous hours of work (and the future subscribers of the cable system considerable expense) by utiliz- ing .the product of such efforts of the attorneys from the south- west. However, it may still be necessary for all of the city attorneys from the four-city area to meet to go over this franchise document should any significant problems be raised relative to any individual city or the document itself. Please feel free to contact me at any time during your review of the document to discuss any questions or problems you may have with the document. I will call a meeting of all city attorneys should it become evident that such a meeting is necessary. Please note that the franchise is not exclusive and there- fore, is not affected by any home rule charter provisions requiring a referendum prior to the issuance of an exclusive franchise by a city. Also note, the preliminary franchise has not been formally adopted by the Cable Commission and changes may be made in the months to come by that Commission, although it is anticipated that extensive revision will not occur. Again, the preliminary franchise will be sent out with the request for proposals, tentatively scheduled to be issued on April 22. Therefore, your review of this document prior to that time would be appreciated. I am enclosing the names of the city attorneys from all other cities in the four-city area for your information. If all proceeds on'schedule, the ordi- nance could enter your city's ordinance process toward the latter part of 1981. I look forward to working closely with you throughout the process.
