I
I
I
I
I

I
I
I
I

CASE #3:

contains the above proposed resolution, submitted for your review and
action. It should be noted that this resolution does not grant metes
and bounds platting, it only commits the Council to do it, providing
both parties agree to the contents of it.

Council Action: Your action will be to approve/disapprove/amend the
contents of the proposed resolution. The following proposed motion is
hereby submitted for your consideration in adopting the resolution:
Motion by Councilmember~$~
[~ ~ ,~ ~ .... ~ and seconded by Councilmember
_.~[~.Q,<~.,~ ~ to adopt Resolution ~82- regarding Outlots "A" and
"B" of C6untryside Estates and Outlot '"A", Rolling.Green Addition
in regards to Mr. Art Raudio's request to subdivide them by metes
and bounds. (Please refer to resolution file for Resolution #82-
.)

Motion carried. Voting yes
Voting no .

SITE AND DESIGN PLAN FOR RECREATION FACILITY, CASE OF MR. OREN LEMKE:

Mr. Lemke will be coming before Council to discuss his proposed recreation
facility with Council.

The first action Council is going to have to take on this case will be to
discuss whether you want this facility on City property, as the present
plans show it being located on City property. Please refer to enclosure
(D2-b) for a map showing Mr. Lemke's proposed building site which will con-
tain a restaurant, lounge, and dance floor. Council should resolve the
land question before Mr. Lemke spends any more money on this plan. Inas-
much as {his land was received in lieu of money for park fee, I think you
should review this with the Park and Recreation Commission before you make
a decision on it.

If Council agrees to work out a land deal with Mr. Lemke, he will then
have to proceed in accordance with our Ordinance which requires and Urban
Development Permit and there is quite a cost involved in accomplishing this
~ part of the Ordinance requirement.

Council Action: Your action on this case probably should follow in this
order:

1)

City Attorney - You probably should discuss this issue with the
City Attorney on a client relationship at the meeting before you
get involved with Mr. Lemke.

2)

City Council - If you like Mr. Lemke's concept, then you will
need to refer him to the Planning and Zoning Commission, whereby
he will proceed with an U~ban Development Permit. He should not
pursue this unless the land issue is squared away, because of the

cost involved.
