I <br /> <br />I <br />I <br /> <br /> WHEREAS, the City has recently surfaced the streets within <br />the Countryside Estates plat; and <br /> <br /> WHEREAS, the City Engineer has determined that approximately <br />one-third of the area in Countryside Estates' drains towards Outlot "B" <br />in said plat; and <br /> <br /> WHEREAS, during periods of heavy rain or fast snowmelt, the <br />area could experience flooding without additional ponding areas; and <br /> <br /> WHEREAS, the owner of Outlot "B" in Countryside Estates has <br />agreed to deed the South half of said-Outlot to the City with the condi- <br />tion that he be granted a variance from the subdivision ordinance to sub- <br />divide Outlots A and B in Countryside Estates and Outlot A in the Rolling <br />Green Add~tion; and <br /> <br /> WHEREAS, the above proposed subdivisions would nOt result in <br />lot sizes that are all smaller than presently exist in the area.' <br /> <br />NOW THEREFORE, BE IT RESOLVED THAT THE CITY AGREES TO ACCEPT THE SOUTH <br />HALF OF OUTLOT "B" COUNTRYSIDE ESTATES WITH THE FOLLOWING CONDITIONS: <br /> <br /> l) The City shall W~ive all subdivision fees involving sub- <br />dividing by metes and bounds and park fees on the above described outlots. <br /> <br /> 2) That the City shall waive the area and frontage require- <br />ments of the City Code for the subdivision of the above described outlots. <br /> <br /> 3) That in the subdivision of Outlot A Rolling Green Addition, <br />the developer shall agree to the following: <br /> <br /> a) Provide adequate soils information to prove to the <br />City that there are two buildable lots under the present <br />City ordinance requirements. <br /> <br /> b) Easements be provided to handle the drainage from <br />the Rolling Green Addition as determined by the City Engineer. <br />If the Outlot is subdividedl it is the intent that the ease- <br />ment be placed along the proposed subdivision line. <br /> <br />c) Easements be provided~for the drainage and upgrading of <br />167th Avenue N.W. to Municipal State Aid Standards as deter-' <br />mined by the City Engineer. <br /> <br /> 4) This resolution only sets the conditions for the sub- <br />division of the abov~ described outlots and does not constitute the sub- <br />division thereof. <br /> <br /> 5) That a certified copy of this resolution be sent to Mr. <br />Art Raudio, 5702 West Broadway, Minneapolis, Minnesota 55428. <br /> <br /> <br />
