CASE #7:

b)

PARK DEDICATION FEE REGARDING JAMES REFRIGERATION PLAT:

The question has been raised on the interpretation of the City Code
in regards to the park dedication fee that should be paid on the plat.

Enclosure (D2-e) contains the following documents:

Mr. Albert's letter dated December 23, 1981 - This letter is
in regards to the park dedication fee which he believes that
they are being overcharged. He thinks they should only be
charged for the one (1) acre platted lot. However, the City
is charging them for the one (1) platted lot plus the outlot
which makes the park dedication fee $3,830 whereas if it was
only the platted lot it would be $218.

Excerpt of the City Code - Enclosed is an excerpt of the City
Code which governs the establishing of the park fee.

Comments: I have discussed this with City Attorney Goodrich and he
I feels the Council should probably review and make this policy decision.
C__o~uncil_ Actio______~n: Your action will be to rule on this case.

I
!

iI
