NOTE BOARD AND COUNCIL <br /> <br />No action by Conunission <br /> <br />D-2 PLANNING CO.XBIlSSION BUSINESS <br /> <br />Case #1 Robert Wojciks request to subdivided by metes and bounds: <br /> <br />(~m:i. rman Peterson read the Findings of Fact out loud. <br /> <br />Mr. Wojcik ~ have purchased property from Mr. Johnson and I am requesting <br />a w. r5ance to build a 40' x 60' building. <br /> <br />Co~uniss~oner Drum - ~my approval or disapp~;oval will have to be with more <br />Find:ings of Fact. <br /> <br />Comnissioner Deemer Requests that Item #6 be added to Findings of <br />Fact stating that original parcel has already been subdivided by metes <br />and botmds. <br /> <br />~ainmn Peterson - City Ordinance does not allow for subdivision by <br />metes and bounds any longer. <br /> <br />Conunissioner Dunn - It hasn't been a hard and fast rule in the past, but <br />I am opposed to metes and bounds rather than platting. <br /> <br />C~]aiman Peterson - Suggests Mr. Wojcik attempt platting with Mr. Shenk. <br /> <br />Mr. Wojcik - It is difficult to talk to Mr. Shenk or his lawyer. <br /> <br /> Motion by Commissioner Deemer, seconded by Commissioner Zimmerman, to <br /> accept the Findings of Fact regarding Mr. Wojcik's request to subdivide <br /> by metes and bound with the addition of Item #6 (Original parcel has <br /> already been subdivided by metes and bounds). Further Discussion: <br /> Commissioner Schneider - request to subdivided by metes and bounds on <br /> original parcel of property was approved by Council as a case of hardship. <br />· Mr. Wojcik can go the same way if he wishes. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Dunn, <br />Zimmerman, Deemer, Ellis and Schneider. Voting No: None. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Ellis, to recommend <br />to City Council rejection of this variance to subdivide by metes and <br />bounds based on the Findings of Fact. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Dunn, <br />Zimmerman, Deemer, Ellis and Schneider.
