Landfall would be a third <br />exclusion, but it is a unique case. Enforcement of the deadline would be in <br />the same manner as described above. <br /> <br />RE COMME NDATIO NS <br /> <br />A. That the Council deal with suspended plan reviews in the following way: <br /> <br />Those local units should be notified that they have two months from the <br />date of suspension or 30 days from the adoption of these guidelines, <br />whichever is later, to comply. <br /> <br />(2) Future suspensions should include notice that no more than two months <br /> will be allowed to satisfy the Suspension. <br /> <br />(3) <br /> <br />In all cases, the sponsoring local governments should be forewarn~ <br />that missing the deadline established by the above method will be <br />treated as if no plan has been submitted and will result in loss of <br />planning grant entitlement eligibility. Further, missed deadlines may <br />lead to negative A-95 and similar Council reviews where actions are not <br />clearly consistent with regional plans and policies, and ultimately to <br />legal action to enforce the MLPA. <br /> <br />(4) <br /> <br />Local units of government unable to meet the applicable suspension <br />deadlines established above, should be further advised that the Council <br />may consider a longer deadline if exceptional circumstances or undue <br />hardships can be documented. These situations will be decided case-by- <br />case based on their merits. <br /> <br />B. That the Council handle local governments which have not yet submitted a <br /> comprehensive plan in the following way: <br /> <br />All such units should be notified that the final deadline for sub- <br />mitting comprehensive plans is 30 days from adoption of these guide- <br />lines. They should also be advised that failure to meet the deadline <br />will mean the Council will enforce the deadline through the same <br />provisions described in Recommendation A(3). <br /> <br />(2) <br /> <br />The case of Landfall should be investigated by the Office of Staff <br />Counsel and [ocal Planning Assistance staff, and a recommended course <br />of action be presented to the Council by September 30. <br /> <br />RCM:TC:emp <br />Attachments <br />09.04.81 <br />EPgg44 <br /> <br /> <br />
