I <br /> <br />I <br />I <br />I <br /> <br />I <br /> <br />CASE #3: REDUCTION OF SPECIAL ASSESSMENT, CASE OF LARRY FERBER, 17501 <br /> <br />BAUGH STREET, REGARDING IMPROVEMENT PROJECT #8~-1~: <br /> <br />Background Information: This was erroneously left off the Council <br />agenda dated September 22, 1981. Mr. Ferber stated at the September <br />8, 1981 meeting that he had been assessed for something he didn't <br />benefit from in this case. <br /> <br />Mr. Ferber had been assessed for a full unit, as he has a corner lot <br />which abutts on Baugh Street NW and 176th Avenue NW. The City Engineer <br />and City Building Official checked out Mr. Ferber's complaint and found <br />that Mr. Ferber did not have a driveway on 176th Avenue. Accordingly, <br />it's recommended that Mr. Ferber receive only a half (~) assessment <br />which would be in accordance with the City policy which is established <br />by City Code. <br /> <br />Enclosure (D2-c) contains the following enclosures for your review and <br />action in this case: <br /> <br />a) Building Official's memo dated September 15, 1981 <br />b) Map showing Ferber's lot and scope of project <br />c) Resolution for Council adoption to reduce his assessment <br /> from one unit to a half (%) unit assessment <br /> <br />Council Action: Your action will be to adopt the proposed resolution <br />contained in the above enclosure. <br /> <br />The following motion is hereby submitted for your consideration in <br />adopting the resolution: <br /> ~tion by Councilmember U~ ~and seconded by Councilm~mber <br /> ~ to adopt Resolution #~1- , a Resolution approving of <br /> 'deleting Mr. Ferber's, 17051 Baugh ~reet, unit assessment from <br /> one (1) unit to half (%) unit for Improvement Project #8~-1~. <br /> (Please refer to resolution file~f~r~solution #81-~.) <br /> Motion carried. Voting yes <br /> Voting no ~ <br /> <br />CASE #4: CORRECTION OF CITY ORDINANCE #81-4 (SCENIC RIVER ORDINANCE): <br /> <br /> Enclosure (D2-d) contains the letter from Mr. Larry Seymour, Division <br /> ~ ~ of Water, DNR, State of Minnesota, which points out certain administrative <br />%~~versights in City Ordinance #81-4. <br />~/ · Council Action: Your action will be to adopt an ordinance correcting <br /> <br /> ..~ ,. <br /> The following motion is hereby submitted for your consideration in this <br /> case: <br /> <br /> <br />
