I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br /> <br />Councilman introduced the motion to adopt the following findings of fact regarding <br />Mr. Scott Golden's (17645 Baugh Street N.W.) request to declare Parcel 7800 non- <br />benefitted by Improvement Project 80-15 and dropped from the assessment roll: <br /> <br />1) The City Council September 4, 1980, ordered a public hearing because of <br />interest shown for street improvements in an adjoining area. <br /> <br />2) A notice of public hearing was placed in the City's official paper and individual liii~!i?i <br />notices were mailed to all affected residents. <br /> <br />3) The public hearing was held September 16, 1980, input was received from numerous <br />residents. However, Mr. Golden's name did not appear i'n the minutes as having had <br />any input. <br /> <br />4) On September 16, 1980, the City Council adopted resolution number 80-112 <br />ordering the improvement. <br /> <br />5) On October 20, 1980, the City Council adopted resolution number 80-144 accepting <br />the bid of N.D.H., Inc. for the proposed construction. <br /> <br />6) On July 28, 1981, the City Council adopted resolution 81-93 ordering a public <br />hearing be held September 8, 1981, for the purpose of determining costs and the <br />proposed assessments. <br /> <br />7) On September 8, 1981, the City Council held the public hearing ~nd adopted <br />resolution 81-128 establishing assessment costs. <br /> <br />8) The assessment policy for all projects was to divide total buildable parcels <br />of land into the total cost to determine a unit assessment. <br /> <br />9) In unplatted areas where parcels exceeded the City lot size requirement, <br />additional units were added accordingly to share in the project costs.' <br /> <br />10) In this area Mr. Golden's parcel contains 703.53 feet of frontage along <br /> 176th Avenue N.W. and over 5 acres including roadways; therefore, it was proposed <br /> for 2 assessments. <br /> <br />11) Using the City's criteria for determining a parcels suitability for building, <br /> there were several parcels that were not assessed. The undeveloped portion of this <br /> property is suitable for building. <br /> <br />12) The City of Ramsey's criteria for determining a parcels buildability are: <br /> <br />a) Adequate areas for the placement of and proper construction of an on-site <br /> septic system. <br /> <br />b) Positive parcel drainage to eliminate flooding potentials under all conditions. <br /> <br />13) On September 8, 1981, Mr' Golden appeared before the City Council requesting <br /> the deletion of this assessment. ' <br /> <br /> <br />
