Councilman introduced the motion to adopt the following findings of fact regarding <br />Mr. James Provinzino's request to declare Parcel 1590 unbenefitted by Improvement <br />Project 80-17 and dropped from the assessment roll: <br /> <br />1) The City Council July 22, 1980, ordered a public hearing because of interest <br />shown for street improvements in an adjoining area. <br /> <br />2) A notice of public hearing was placed in the City's official paper and indivi- <br />dual notices were mailed to all affected residents. <br /> <br />3) The public hearing was held September 23, 1980, input was received from numerous <br />residents. However, Mr. Provinzino's name did not appear in the minutes as having <br />had any input. <br /> <br />4) On September 30, 1980, the City Council adopted resolution number 80-121 order- <br /> ing the improvement. <br /> <br />5) On October 14, 1980, the City Council adopted resolution number 80-133 accepting <br />the bid of N.D.H., Inc. for the proposed construction. <br /> <br />6) On July 28, 1981, the City Council adopted resolutio~ 81-98 ordering a public <br />hearing be held September 8, 1981 for the purpose of determinin, g costs and the <br />proposed assessments. <br /> <br />7) On September 8, 1981, the City Council held the public hearing. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />8) On August 18, 1981, the City Council passed a motion to assess Project 80-17 <br />Tungsten Street overlay at a unit cost of $200 for those units which have access on <br />Rivlyn Avenue and Front Street and assess the remainder of the project on a front <br />foot basis for those units adjacent to Tungsten Street. <br /> <br />9) Based on the half section maps Mr~ Provinzino's lot has approximately 100' of <br />access on Front Street and was proposed to be assessed for one unit. <br /> <br />10) On September 8, 1981, Mr. ~rovinzino appeared before the City Council requesting <br /> the deletion of this assessment, because Front Street has not been constructed' <br /> along his property. <br /> <br />11) On September 14, 1981, the parcel was reviewed by the City Engineer and the <br /> Building Official, and Front Street was not found to be constructed up to Mr. Pro- <br /> vinzino's lot nor did it provide access to the property. <br /> <br />12) Based on a staff recommendation the City Council ordered the preparation of <br /> findings of fact for their reviewal at their next regular meeting of September 22, <br /> 1981. <br /> <br />'1 <br /> I <br /> <br /> <br />
