PUBLIC PARTICIPATION <br />I <br /> REQUIREMENTS <br />I The Revenue Sharing Act, amended, <br />requires each State and local government to <br />ruth'!ce certain actions to encourage citizen <br />~i'~ 'c,t"~:;e:-;t in ~he Program. Briefly, each <br />· :.vei'nlaent must hold two public meetings <br /> <br />Ior hearings before its officials decide how <br />revenue sharing funds will be spent. Later, <br />nc~lices must be publiahed which inform <br />Ici~izens as to lmw the money was aCtually <br />rs:cd. This section of the bool-:let gives an <br />explanation of these public participation <br />irequlrements. The Check List immediately <br />preceding this page provides handy refer- <br />ence points and oullines the procedures. <br />IPublic Notice of Proposed Use Hearing <br /> <br /> ' <br /> tailed the "Proposed Use <br /> Hearing," must be held before <br />ih. F=-~-~-~-~ a proposed~~~ budget is pre- <br /> sented to the legisIative body <br /> for enactment. Your govern- <br /> <br />iment must advertise this meeting bY pro- <br />viding notice to the public in a newspaper of <br />general circulation. The notice must appear <br />~no later than ten (10)' dayo before the date of <br /> the meeting. It must include the following <br /> information: <br /> <br />budget must conduct this meeting. Citizens <br />of your community must have a chance to <br />suggest uses for revenue sharing money. <br />These suggestions may be made orally or in <br />writing. The seven-day period mentioned <br />above is important because it ~ives adminis- <br />trative antl executive officia!~ ~i~a-~e to <br />consider your suggestions before the pro- <br />posed budget goes to the legislative body. <br />Many governments may wish to hold the <br />proposed u~e hearing much earlier in the <br />budget development proce~. The Office of <br />o .., ~.~rmg encourages this practice. <br /> <br />Proposed Use Hearing Alternative <br /> <br />For some small governments, the cost of <br />holding the proposed use hearing may be a <br />financial burden. If the cost of space, <br />furniture, equipment rentals, overtime com- <br />pensation, and similar direct costs, including <br />the costs of pubIication of the public notice, <br />would exceed' fifteen (15) percent of the <br />revenue sharing money which a government <br />expects to receive for an entitlement period, <br />the Director of the Office of Revenue Sharing <br />may grant a waiver of the proposed use <br />hearing requirements. <br />In addition,.a government does not have to <br />hold a special meeting to comply with the <br />proposed use hearing requirements. The <br /> <br />I· Date, time and location of the meeting proposed use hearing may be part of a <br /> <br /> · Amount of unused revenue sharing regularly scheduled meeting, such as a <br /> money available monthly council meeting. However, the <br />I recipient government must still meet the <br /> · Amount of revenue sharing money to be public notice and timing requirements. <br /> <br />i <br /> <br /> Proposed Use <br /> <br />Public Notice <br /> <br />of Budget Hearing <br /> <br />The second public meeting, <br />called the "Budget Hearing," <br />must be held after a proposed <br />budget has been presented to <br />your government's legislative <br />body, but prior to its adoption. <br /> <br />Your government must advertise this meet- <br />ing by providing notice to the public in a <br />newspaper which serves your community. <br />The notice must appear in the newspaper at <br />least ten (10) days prior to the day of the <br /> <br />having responsibility for development <br /> <br /> received in the coming fiscal year <br />· A statement that the public will be given <br /> the opportunity to make oral and written <br /> suggestions regarding possible uses of <br /> revenue sharing funds. <br /> <br /> Hearing <br /> <br /> Your government must hold <br /> this public meeting at least <br /> seven (7) days before a budget <br /> including revenue sharing <br /> funds is presented for enact- <br /> ment.
