I <br />I <br /> <br />I <br />I <br /> <br />I <br />I <br /> <br />I <br /> <br />PROPOSED FINDINGS OF FACT <br />RE JAMES REFRIGERATION <br /> <br />1) In conjunction with a plat request the applicant is proposing a ~u.perette <br />and gas pumps use on part of the North Half of the SOuthwest Quarter.of <br />Section 23, Township 32, Range 25 lying easterly of the center line of County <br />State Aid Highway No. 5 Lot 1 Block 1 Marx Estates. <br /> <br />2) That the applicant requires an Urban Development permit in conformance <br />with Section 170.015 of the City Code. <br /> <br />3) That the subject property is located in the City's UMB zoning district <br />which is defined as a district having the general intent to accommodate <br />medium donsity residential housing, offices and personal use type business <br />all intended to act as a periphery zone to the UB district. <br /> <br />4) That the UMB district has as permitted uses: <br /> <br />a) Residential housing with density between five and 25 dwell- <br /> ing units per acre <br /> <br />b) Personal professional services <br /> <br />c) Eating places with indoor seating for 60 people. <br /> <br />d) Churches <br /> <br />e) Public building and libraries <br /> <br />f) Offices and banks <br /> <br />g) Funeral homes <br /> <br />h) <br /> <br />i) <br /> <br />Clinics and pharmacies <br /> <br />Retail business if the City Council shall find no adverse <br />impact on the area in accordance with the review process of <br />Section 170.O15F. <br /> <br />5) That this use if permitted can be granted only pursuant to Paragraph 4 <br />above. <br /> <br />6) That the City Code does not require a public hearing to grant the use <br />requested by the applicant, however, the Council desired a public hearing <br />and, therefore, a public hearing was held on August 25, 1981 at the City's <br />Municipal Center. The minutes of said hearing are incorporated herein by <br />reference. <br /> <br />7) That the proposed use will add approximately $250,000 to the City's <br />tax base. <br /> <br /> <br />
