I write this letter with regard to that <br />question. <br /> <br />It would appear from the reading of the ordinance itself, that a superette without <br />two gasoline pumps is an allowable use under the ordinance without any requirement <br />or permission from the City. If this is so, then the City has already determined <br />what impact it has on the rest of the community by its zoning. People who had <br />opposed it or opposed the granting of any use permit on the basis of the superette <br />would have no right to oppose it, because it is zoned that way. It seems that their <br />contention is two things, (1) an increase in traffic, and (2) a danger to child- <br />ren at the school. The sbho~l authorities inform us that children are to be kept <br />on school grounds during school hours and for the most path are bused in and bused <br />out. If the superette.can.be allowed anyway and is an attraction for children, it <br />would be an attraction regardless of the pumps. The real question boils down then <br />to whether or not the two gasoline pumps have an adverse impact on the community. <br />There are several areas where these are located andare located because of zoning <br />of commercial. The arguments concerning litering are not a factual situation in <br />the other two locations. The other arguments of impact are not really germane as <br />far as the children are concerned. They certainly aren't goingto have.children <br />cross the street for gasoline purchasing. There would be automobile trafFic--they <br />would drive in to buy groceries and perhaps gasoline. In view of the allowable uses <br />which permits restaurants with seating capacity and other forms, it would seem to <br />me that the other forms can take the form of all kinds of retail stores that are <br />allowable, like beauty shops, etc., that draw traffic in all during the day. The <br />same argument could be made against those as can be made with regard to the super- <br />ette, and one would be allowed and the other not allowed because of the addition of <br />two pumps. <br /> <br />While it may be the contention that a tax variable base is not an issue, and with <br />all due respect to those who feel that it is not an issue, we feel that a variable <br /> <br /> <br />
