to Sectionl70.0]5Fto the city council and planning commission for <br />action. <br /> <br /> 1. The planning commission sball conduct a public hearing <br />on the urban development permit application and shall give at least <br />tcn (]0) days mai]ed notice to property owners within three hundred <br />fifty (350) feet of the ot, ter boundaries of the property in question. <br />Ten (]0) days published notice shall also precede the hearing. Any <br />person may appear and testify at the hearing either in person or by <br />duly authorized agent. The planning commission shall forward its <br />findings on the application to the city council within thirty (30) <br />days of the public hearing, unless the applicant agrees in writing to <br />a time extension. <br /> <br /> 2. The city council shall review the application, zoning <br />officer's f~ndJngs and findings of the planning commission and shall <br />act on said application within thirty (30) days after receipt from the <br />planning commission. If the city council denies the application, that <br />action shall be the city's final administrative act on the application. <br /> <br /> 3. If the city council approves the application, as a condi- <br />tion of tb~t approval, the council may attach such conditions as it <br />dec,ns necessary. All development, construction and use shall be in <br />accordance with the approved site plan and conditions required by the <br />city council. Any development not in accord with the approved plan <br />shall constitute a violation of this chapter. <br /> <br /> 4.
