PROPOSED <br />FINDINGS OF FACT <br />RE: RAND~I,L LINDGREN <br />CONDITIONAL USE PERMIT <br /> <br />1 ) That the applicant has properly applied for a conditional use permit <br />as required by City Ordinance to maintain a private kennel. <br /> <br />2) That the applicant appeared before the Planning and Zoning Commission <br />for a public hearing p~rsuant to the City Zoning Ordinance on June 2, <br />1981. That said public hearing was properly advertized and the minutes <br />of that public hearing are hereby incorporated by reference. <br /> <br />3) That the Standards for Consideration are as follows: <br /> <br />a) The property is zoned R-1 and this is not a permitted <br />use, <br /> <br />b) The adjoining proPerties are residential dwellings <br />located on approximately one to five acre parcels. <br /> <br />c) The closest similar use is approximately three (3) <br />miles. <br /> <br />d) There will be no change in traffic flow to the area. <br /> <br />e) There are three (3) known kennels in operation in the <br />City which to our knowledge have not caused neighborhood <br />problems. However~ there are numerous individuals that <br />should have conditional use permits for private kennels <br />that do cause problems because of a lack of proper facili- <br />ties to control auimals. <br /> <br />f) Properly maintained, the kennel should not affect the <br />life style of the neighboring residents in a rural setting <br />Further, it should not affect the enjoyment or value of <br />properties in the vicinity.- <br /> <br />4) That the Criteria for Approval/Disapproval are as follows: <br /> <br />a) The applicants request to maintain five (5) adult hunt- <br />ing dogs, if properly maintained, should not be detrimental <br />to or endanger the public health, safety or general welfare <br />and is not contrary to established standards as regulated <br />by City Codes. However, persistent barking would be a <br />nuisance, <br /> <br />b) The applicants proposed kennel area has not been viewed <br />by a Doctor of Veterinary Medicine as required of previous <br />conditional use permits of this nature. <br /> <br /> <br />
