Joint planning boards for unincorporated <br />territory within two miles of the city limits <br />If a city has unincorporated area within two miles of the corporate limits of a <br />city, a joint planning board may be formed. A city council or a county board <br />or a town board may require the establishment of a joint planning board on <br />their own initiative by passing a resolution requiring a board to be <br />established. The resolution, once passed, must be filed with the county <br />auditor. <br />The city, county and town must agree on the number of board members for <br />the joint board. However, each participating governmental unit must have an <br />equal number of members. The members must be appointed from the <br />governing bodies of the city, county and town. <br />Once established, the board is authorized to: <br />• Serve as the governing body and board of appeals and adjustments <br />within the two-mile area. <br />• Create a planning agency. <br />• Create a BZA. <br />• Adopt a comprehensive plan. <br />• Adopt interim ordinances. <br />• Adopt zoning ordinances. <br />• Adopt subdivision regulations. <br />• Adopt an official map. <br />• Provide for and issue conditional use permits. <br />• Enforce official controls and prescribe penalties for violations. <br />• Adopt and enforce the State Fire Code. <br />The city must provide staff for the preparation and administration of land <br />use controls unless otherwise agreed by the governmental units composing <br />the board. <br />League of Minnesota Cities Information Memo: 1/20/2015 <br />Planning Commission Guide Page 26 <br />
