7. The Park impact, proposed mitigation, and a proposed Section 4(f) de minimis finding will be <br />reported in the Environmental Assessment (EA) that is being prepared for the Project. This <br />EA will be published and a public hearing held to provide the opportunity for public <br />comment on the features, activities and attributes of the Park. The final determination of <br />Section 4(f) de minimis applicability will be made by FHWA following a review of any <br />public comments received. <br />8. This Memorandum of Understanding will be re-evaluated and amended, if required, upon <br />any of the following conditions: <br />a. Proposal by any of the Signatory Agencies to implement specific Section 4(f) impact <br />mitigation measures; and, as specific mitigation is defined, documenting the terms of <br />agreement between Mn/DOT and the County of Anoka regarding the proportion of <br />mitigation costs to be paid by each agency. <br />b. Re-evaluation of the Project under NEPA. <br />e. Request by any of the Signatory Agencies. <br />- 3 - <br />
