NOW THEREFORE Mn/DOT, County of Anoka, Metropolitan Council, and MnDNR <br />(Signatory Agencies) agree as follows: <br />1. Before takings for the Project, the Park parcel contains approximately 274 acres. Based on <br />preliminary engineering conducted for the current study, the right of way needed for the <br />Project plus the severed parcel totals 8.0 acres of Park land, (Parcel A depicted in Figure 1 <br />attached), the acquisition of which constitutes a use under Section 4(f). Parcel A is also part <br />of the LCMR-funded native prairie restoration area within the Park. <br />2. Minimization of impacts through the removal of the extension of Riverdale Drive west of <br />Ramsey Boulevard from the Project will not be part of this Project because this extension, <br />which is consistent with the City of Ramsey's transportation plan, is needed to restore access <br />to properties on the south side of TH 10. <br />3. Mitigation of the Project's Park land acquisition impact is subject to approval by the <br />Metropolitan Council in accordance with the requirements for conversion of regional parks <br />system lands to other uses as outlined in the Regional Parks Policy Plan. Lands within the <br />regional park system can only be converted to other uses if approved by the Metropolitan <br />Council through an equally valuable land or facility exchange. <br />Mitigation of the Project's Park land acquisition impact will occur through one of the <br />following methods: <br />a. Acquisition of replacement land of reasonably comparable to the value to Parcel A. <br />Replacement land will be adjacent to the Park or another regional park within the County <br />of Anoka. <br />b. Financial compensation to Anoka County Parks, in an amount equal to the value of the <br />acquired Park land, for the purpose of Park development. <br />c. A combination of the two methods above in amounts that together are reasonably <br />comparable to the value of Parcel A. <br />The Metropolitan Council makes the final decision on whether or not there is an equally <br />valuable land or facility exchange. <br />4. Mitigation of the Project's impact to the native prairie planting on Parcel A will involve <br />native prairie restoration (with local ecotypes) of an area, like in size, elsewhere in the Park, <br />the location and details of which will be subject to MnDNR review and approval. <br />5. Mitigation of Park impacts may occur in advance of Project construction if opportunities <br />arise. Mitigation details and agreements will be finalized among the Signatory Agencies prior <br />to implementation of mitigation or prior to Project construction, whichever occurs first. <br />6. In consideration of the above -referenced Project impacts and mitigation provisions the <br />Signatory Agencies with jurisdiction over the Park resource agree that the Project does not <br />adversely affect the activities, features or attributes of the Park. <br />-2- <br />
