Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #16-01-013 <br />A RESOLUTION APPROVING THE ISSUANCE OF A HOME OCCUPATION PERMIT <br />TO OPERATE A FOOD TRUCK BUSINESS WITH ONSITE FOOD PREPARATION ON <br />THE PROPERTY LOCATED AT 7960 171ST LANE NW BASED ON FINDINGS OF FACT <br />#0960 AND DECLARING TERMS OF PERMIT <br />WHEREAS, John and Anne Reineck properly applied for a home occupation permit to <br />operate a food truck business with a commercial grade kitchen for onsite food preparation on the <br />property generally known as 7960 171' Lane NW and legally described as: <br />Lot 3, Block 1, Dellwod Hills, Anoka County, Minnesota <br />(the "Subject Property") <br />WHEREAS, the Ramsey Planning Commission met on January 7, 2015, conducted a <br />public hearing, and recommended City Council approve/deny the request; and <br />WHEREAS, the Ramsey City Council adopted Resolution #16-01-012 adopting Findings <br />of Fact #0960 for this use and herein approves the home occupation permit. <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />On January 26th, 2016, a home occupation permit ("Permit") was issued by the City of Ramsey <br />("CITY") to John and Anne Reineck ("PERMITTEE") to operate a food truck business with a <br />commercial grade kitchen for onsite food preparation on the Subject Property. <br />This Permit is issued pursuant to Sections 117-51 and 117-351 of the Ramsey City Code. The <br />conditions of this Permit are as follows: <br />1. That this resolution shall allow for a food truck business with a commercial grade kitchen <br />for onsite food preparation (the "Home Occupation") to operate in a portion of the attached <br />garage on the Subject Property. The PERMITTEE shall be required to reserve at least <br />400 square feet of accessory structure space for the purposes of the primary residential use. <br />2. That the PERMITTEE shall reside in the dwelling unit of the Subject Property and is <br />allowed up to one (1) non-resident (does not reside at the Subject Property) employee. <br />Notification must be given to the CITY if the PERMITTEE will utilize a non-resident <br />employee. <br />3. That the Home Occupation business hours are part-time and on-site business activities <br />occurring at the Subject Property will not exceed 30 hours each week. This includes time <br />spent on food preparation, operation of the smoker, and the loading and unloading of the <br />
