RECOMMENDATION: <br /> <br />The city should review the existing uses in Zone B and determine <br />whether certain types of use on undeveloped lots should be prohibited <br />from Zone B. <br /> <br />RESPONSE TO MR. PETTIT'S (TOM THUMB) CONCERNS: <br /> <br />Mr. Pettit's understanding that their store no longer could exist if <br />the Zoning Ordinance is adopted is erroneous. All uses currently <br />existing in Zone A would be "grandfathered" in and could be continued. <br />At the time when the use or land would be acquired, the owner is <br />entitled to receive fair market value for the property. The proce- <br />dures for acquisition must meet the federal requirements of the "Uni- <br />form Relocation Assistance and Real Property Acquisition Policies Act" <br />of 1970. FAA's Advisory Circular 150/5100-11 provides guidance and <br />information which address the procedures, rights of property owners, <br />relocation assistance, etc. Copies of this AC have been ordered and <br />will be made available to each of the affected property owners at the <br />appropriate time. Relocation and moving expenses are eligible items <br />under the acquisition program. <br /> <br />The City had expressed itslintent to fund acquisition and eligible <br />improvements through the use of Airport Improvement Program (AIP) <br />Funds providing up to 90% funding. The remaining 10% would be fi- <br />nanced from the City through a n~mher of means. These may include <br />accumulated funds, tax increment funds, general funds, bonds or com- <br />binations of these mechanisms. <br /> <br />Obviously, businesses are an asset to the Community and the City is <br />interested not only in new:businesses but in retaining those which are <br />existing. To that end, the City can be expected to work with both <br />businesses and residents for the common good. <br /> <br />RECOMMENDATION: <br /> <br />No changes are required to zoning plans or the Zoning Ordinance. It <br />may be beneficial for a representative of Tom Thumb to meet with a <br />member of the City's staff to discuss their concerns more fully. <br /> <br />RESPONSE TO MR. AND MRS. NIX: <br /> <br />The comments expressed do not pertain to the airport or airport <br />zoning. <br /> <br />RESPONSE TO MR. PATRICK KENNEDY'S CONCERNS: <br /> <br />A memo to the city Administrator dated March 30, 1987 addressed ap- <br />proach slope clearances over railroads. The airport improvements are <br />based on meeting state and ~ederal requirements for approach slopes <br />a~d clearance over all traverseways including railroads.
