A Tree Preservation Easement has been submitted by the Applicant and <br />appears that it will provide sufficient protection of the wooded area between the existing and proposed neighborhoods.. <br />Tree Preservation. A Tree Inventory and Preservation Plan was submitted and approved as part of the review of the <br />Preliminary Plat. The bulk of the protected trees occur in the southern portion of this addition and shall be retained to serve as <br />a transition between the newly created lots and the existing neighborhood to the south. Tree save fencing shall be installed prior <br />to commencement of any earthwork and shall remain in place throughout the duration of the project. <br />Topsoil. Each individual lot will be subject to the City's topsoil requirement. Copies of the load tickets shall be provided for <br />each property and topsoil shall be approved by the City prior to installing landscaping. There shall be no topsoil placed within <br />any delineated wetland or tree preservation area. This is reviewed at time of Building Permit Application and request for <br />Certificate of Occupancy for each individual lot. <br />Wetlands: The site contains several areas of existing wetlands. The Wetland Conservation Act (WCA), enacted by the State <br />Legislature, prohibits certain activities from occurring within a wetland, including draining, filling and excavating. In order to <br />ensure compliance with the WCA standards, silt fencing along the delineated boundary of wetlands will need to be installed and maintained throughout <br />the duration of construction, including the final landscape improvements on individual lots. This will be instrumental in preventing fill (topsoil and <br />sod) from being placed within the delineated boundaries of a wetland <br />Development Agreement and Development Fees: <br />The Developer shall be required to enter into a Development Agreement with the City. A draft of the Development <br />Agreement is included. Note that the Applicant has provided the City an estimate of costs for all public improvements, <br />including the cost of the cul-de-sac bulb (even though it is not being constructed at this time). The City has identified <br />several costs that are missing and need to be incorporated. These are outlined in a review memo from our Engineering <br />Department dated April 5, 2016. An estimate of the required Development Fees is also included in the DRAFT <br />Development Agreement. <br />
