Location of property: Lot 9~ Block 2, and Outlot A, Block 2 of Carol Rose
Acres.

Mr o D~ncan Johnson was present and reviewedhis proposal with the Council.

Option #1 was recommended to be disregarded by the City Engineer, Pete Raatikka.

Mr. Johnson said that he wants to give land to his brother so_he can ~build a
house and that there is Some question to the frontage meeting the requirements and
that is why he presented the two options.

Engineer Raatikka stated in his report that even to meet regulations, Option
#2 would mean moving the~lot line of Lot 9 at least 45 feet north because
he doesn't meet 2½ acres area requirements.

Mr. Johnson stated that when he originally built his home he could have
placed his home on the other side of the lot from where it is and therefore
he feels that there should be no reason that the property to the west would
be unbuildable now.

Ben Deemer explained that he could have placed his house in other locations
on the lot so that he could have a chance to future subdivide when and if
sewer is available. ~@. Deemer also pointed out that Mr. Johnson i~ in
fact asking for a subdivision to create three lots.

Gerald Zin~erman abstained on this issue because he lives in the area.

Chairman Peterson questioned why Mr. Johnson could not make it just two
lots instead of three, in fact there would be no reason why he couldn't
leave his lots just the way they are and apply for a building permit
for the northeasterly corner of the outlot, if it would meet the soil
conditions for septic systems etc. It was further explained to Mr. Johnson
that if the Outlot A lot could not meet the soil conditions then the
proposed lot shown in Option #2 would not meet the soil condition requirements
either. Mr. Johnson was informed that he could seek a building permit from
the City building offioial and just drop the platting proposal.

~r.Johnson concurred wit~ this suggestion and stated that he was under the
impression that he could not build on an outlot.

Chairman Peterson further stated that he could give Outlot A to his
brother with some sort of an agreement between the two of them that if sewer
does go through someday, that part of the outlot would belong to Mr. Johnson
and he should have an attorney draw up the proper legal documents to cover his
interest in the land.

Chairm~n ?eterson cancelled the Workshop meeting for the m~nth of December.

Mayor Gamec was present at the meeting and reported the status of the
sanitary sewer trunk line connection to the P & Z Commission.

Regular Meet,lng - 12/$/79

Page 2
