It was the consensus of the Commission that a scenic easement be shown on the <br />plat also. <br /> <br />Chairman Peterson stated that it should be noted that 142nd Avenue N.W. is <br />to be platted extra wide to allow for a trail system, which will result in <br />four more feet of paving from the easterly boundary of the plat to the <br />westerly boundary. <br /> <br />The no name street parallel to Highway 10 in the commercial area of the plat <br />is required to be 42 feet of blacktop, curb back-to-back. <br /> <br />Chairman Peterson questioned if Armstrong Boulevard should be built up to <br />collector status at this time. <br /> <br />Consensus of the Commission is that 32 feet is sufficient with "no parking" <br />allowed. <br /> <br />CONDITIONAL USE PERMIT REQUEST - WILLIAM AYDT <br /> <br />Chairman Peterson explained that Mr. Aydt has a non-conforming use in a <br />UMB zoned District. <br /> <br />Administrator Schnelle explained that the conditions should follow through <br />to the next owner of the property and some guidelines and it would be transfer- <br />able so the person purchasing the property will know that there are some <br />restrictions. <br /> <br />Chairman Peterson stated he can continue with his business, auto body <br />repair, or that he can operate any of the permitted uses under UMB zoning <br />on his property. <br /> <br />Mr. Aydt stated that the number of employees he has depends on how busy <br />he is and that he had 3 or 4 guys this summer but now he is on his own <br />with an ocassional part time man and that only body work and painting is <br />performed in his shop and that occasionally he sells cars. <br /> <br />Discussion was held. It was noted that anytime the owner of this property <br />wanted to expand or enlarge, he would have to go before the Council. <br /> <br />Chairman Peterson told Mr. Aydt that if he expands the business that would <br />change the conditions under which he is operating and if he changes any of <br />these conditions he would have to come back in and make a request for site <br />plan and building design approval and conditional use revision. <br /> <br />Mr. Aydt questioned if he could build the building he was given permission <br />to build by the Council earlier this summer. <br /> <br />Mr. Schnelle stated that his request to construct the new building is what <br />brought this matter to light in the first place and he feels it is Council's <br />intention that he be given a conditional use only on his present operation and <br />that any further expansion, etc., he would have to apply for consideration to <br />do so. <br /> <br /> Regular Meeting <br />Planning & Zoning Commission - 10/1/79 <br /> --5-- <br /> <br /> <br />
