Motion by Commissioner Brauer, seconded by Commissioner Andrusko, to recommend that City
Council adopt Resolution # 16-04-070 granting an amended Conditional Use Permit to Bethel
Properties, LLC, contingent on compliance with the Staff Review Letter dated April 1, 2016,
directing staff to ensure there is language that calls out the need for 24 foot drive aisle width.
Motion Carried. Voting. Yes: Vice Chairperson Bauer, Commissioners Brauer, Andrusko, Maul,
Nosan, and VanScoy. Voting No: None. Absent: Chairperson Levine.
5.05: Public Hearing: Consider Amendments to Wetland Protection Overlay District to
Establish Wetland and Storm Water Pond Setbacks and Establish a Minimum Lot
Depth for Newly Created Residential Lots (Project No. 16-39)
Public Hearing
Vice Chairperson Bauer called the public hearing to order at 8:56 p.m.
Presentation
City Planner Anderson presented the staff report stating the purpose of this Ordinance is twofold.
First, it is to bring the City into compliance with the Lower Rum River Watershed Management
Organization's (LRRWMO) 3rd Generation Plan by implementing a wetland setback. The
second purpose of the Ordinance is to address feedback from residents over the past couple years
regarding remaining buildable area on some parcels after wetlands and floodway have been
factored out. The Ordinance establishes a minimum lot depth for all newly created residential
lots in an attempt to provide a reasonable rear yard to accommodate common homeowner
improvements such as decks and sheds. Staff explained the Environmental Policy Board
reviewed the draft Ordinance at its February 22, 2016 meeting and recommended City Council
adopt Ordinance # 16-03.
Citizen Input
Commissioner VanScoy asked if the City Engineer had any issues with the proposed Ordinance.
Civil Engineer Linton explained he has been fully involved in the Ordinance process and
supported the proposed setbacks. He believed the new Ordinance would greatly assist property
owners in the future.
Motion by Commissioner Maul, seconded by Commissioner VanScoy, to close the public
hearing.
Motion Carried. Voting Yes: Vice Chairperson Bauer, Commissioners Maul, VanScoy,
Andrusko, Brauer, and Nosan. Voting No: None. Absent: Chairperson Levine.
Vice Chairperson Bauer closed the public hearing closed at 9:07 p.m.
Planning Commission/April 7, 2016
