and 2008. He was pleased to see there was a demand for housing again. He understood he <br />would need to work through the infrastructure agreements with the City. He encouraged the <br />Planning Commission to support his request. <br />Community Development Director Gladhill reviewed, for a point of reference, the original plat <br />noting the developer had previously requested 77 lots. <br />Commissioner VanScoy questioned how much of the new plat would be greenspace. He asked if <br />there were any safety concerns with the proposed depth of the pond. <br />Community Development Director Gladhill reviewed the greenspace within the proposed plat. <br />Curt Quantance, engineer for the project, explained he engineered both the 2007 and 2016 plats. <br />He explained the only difference was that an entrance had been cut off and the stormwater pond <br />had been enlarged. It was noted in 2007 he had proposed an infiltration basin, which was no <br />longer allowed. He did not believe the 4'/2 foot pond was too deep should not become a safety <br />concern. He explained the slope would be very flat for the first 10 feet. <br />Community Development Director Gladhill reported the Preliminary Plat had been reviewed by <br />the City Engineer and the Public Safety Team and no concerns were raised regarding the <br />stormwater pond. <br />Motion by Commissioner VanScoy, seconded by Commissioner Andrusko, to close the public <br />hearing. <br />Motion Carried. Voting Yes: Vice Chairperson Bauer, Commissioners VanScoy, Andrusko, <br />Brauer, Maul, and Nosan. Voting No: None. Absent: Chairperson Levine. <br />Vice Chairperson Bauer closed the public hearing closed at 7:29 p.m. <br />Commission Business <br />Commissioner Brauer asked how vetted the City was to the previous plat. <br />Community Development Director Gladhill indicated the City was not obligated to the previous <br />preliminary plat due to the fact the plat was not extended. The property has since defaulted back <br />to current zoning regulations. He explained the Commission could grant the additional five <br />units. He provided further comment on the current zoning requirements within The COR, along <br />with the tools (variance or PUD) available for the Commission. <br />Commissioner VanScoy indicated the proposed plat does not meet the City's requirements at this <br />time. For this reason, he did not support approval. He feared a precedent would be set. He <br />suggested a variance or PUD be pursued.
