P&Z-2- <br />3/8/79 <br /> <br />Art Dunn asked Mr. Carson that in the event sewer is available would there be <br />mandatory hookup. It was:pointed out that the Council would have to petition <br />or Public Hearing. Mr. CarsOn stated that both his and the City's Attorneywere <br />working on restrictive covenants which would make it clear to the purchaser of <br />the lot that when sewer is available, it would be brought in. <br /> <br />In regards to the Park dedication question, a letter from Kathy Schneider was <br />read stating that she recalled that the land dedicated in Flintwood I plus <br />land adjacent to the old city hall was supposed to meet the requirements for <br />both plats. Ken Peterson stated that he also recalled the proposal being dis- <br />cussed when he was on the Park Commission. <br /> <br />The Screening question was, also addressed with Mr. Carson suggesting that he <br />donated $500 to the Park fund for development in Flintwood I. As the members <br />of the Commission could not recall the specifics for the screening, they re- <br />commend that the Council examine this. Art Dunn also asked Mr. Carson if <br />he had contacted the DNR regarding filling of wetlands, and Carson stated that <br />he didn't believe he would'actually be filling any, but could contact them if <br />needed. <br /> <br /> Motion by A1 Sorteberg, seconded by Brad Bodle, to recommend ,to the City <br /> Council to approve the preliminary plat of Flintwood Hills Plat II subject to <br /> the following condition, s: <br /> 1.) Variance be grant, q=rom ~ection 170.04 of the zoning ordinance which requires <br /> 50% of each site be suitable soils for sewer system prior to preliminary plat <br /> approval. <br /> 2.) Variance be granted from section 170.38H of zoning ordinance which requires <br /> inspection and approval~of each site by building official/engineer prior <br /> to preliminary plat approval. <br /> 3.) Variance be granted to allow access from Lot l, Block I unto Industry Ave. <br /> 4.) Variance be granted on Lot 6, Block 6 to allow a UB zoned lot be deficient in <br /> depth. <br /> 5.) That lot 12, block 4; lot 10, block 5; & lot 8, block 7 meet lot size re- <br /> quirement prior to approval. <br /> 6.) That taking into consideration letter from Kathy Schneider of March 6, 1979 <br /> park dedication be resolved. It was the consensus of the commission that <br /> adequate dedication has been made. <br /> 7.) That drainage problem from Flintwood I be resolved. <br /> 8.) That adequate screening 6e provided, and if no longer Yeasible, $500 be <br /> donated to the park fund for Flintwood I park. <br /> 9.) That seeding be provided~in areas that are cut and filled to prevent errorsion. <br />10.) That sanitary sewer be addressed in restrictive covenants to the satifaction <br /> of City Attorney, and Council. <br />11.) That conditons referred to in items #1 & 2 be met prior to issuance of any <br /> building permits, and with additional costs billed to developer. Motion carried 6-0. <br /> Art Dunn asked if Carson anticipated all the commercial lots would be developed <br /> prior to sanitary sewer, and Mr. Carson stated that he hoped so. <br /> <br />Critical Rivers <br />The Commission held a work session on the policies for the Critical areas section <br />of the plan. Ken Peterson stated that he would be calling Mr. Marston and <br />relaying the changes requested by the Co~mission. The commission Will be meet- <br />ing with the Council to present the plan on March 22, 1979. <br /> <br /> <br />
