these regulations, he does not think he can get help in that fast to change the way the doors <br />swing. <br />Mayor Strommen stated this was likely approved as an accessory building to begin with, and not <br />a place for 150 people. She noted there is some concern of liability on the part of the City. <br />Community Development Director Gladhill stated this was not Mr. Wattenhoffer's property at <br />the time of zoning. It was approved as a horse riding arena. Down the road, it became known <br />that this was a fabrication building and there are residents. He said he will let Staff handle the <br />inspections and use their jurisdiction of what is acceptable for safety reasons. <br />Councilmember Kuzma stated he would like to hear from the Fire Marshal if he would consider <br />working with this property and keep the doors as is for the event. <br />Community Development Director Gladhill noted the Fire Marshall was at the inspection, <br />however the Fire Chief is at the meeting to answer that question. <br />Fire Chief Kohner explained there are different avenues that can be taken if the doors cannot be <br />turned around. They could be removed, or turn them around in a different configuration. They <br />must be removed, or secured in a way that they are not propped open and cannot close on their <br />own. <br />Councilmember LeTourneau stated he would like to hear from the City Attorney that correcting <br />the doors, or removing them, would absolve the City of any liability. <br />City Attorney Langel explained the City does not incur liability if someone fails to follow code' <br />initiated by the Fire Marshall or a building official. The owner would be at fault, should <br />something happen. <br />Mr. Wattenhoffer stated that part of the reason to keep the doors closed is because of A/C <br />running, or if it is cold outside. Also, the sound is much more prevalent with open doors. He <br />said he has maybe 7 doors in the building, and he is not sure how much money it would take to <br />turn the doors around. He offered to check on how fast that can occur. <br />Mayor Strommen noted that if the permit is granted, and the inspection before the event reveals <br />some of this work is not done, then it is not a valid permit. <br />Councilmember Riley asked if these four criteria are something the owner felt he could comply <br />with. <br />Mr. Wattenhoffer responded he could not answer that without information from a contractor to <br />change the door(s). <br />Mayor Strommen suggested the Council could deny the permit, or it could approve the permit <br />with the conditions while Mr. Wattenhoffer does his best to comply before the event. <br />City Council / April 26, 2016 <br />Page 9of13 <br />
