Page 2 <br />Planning & Zoning Memo <br /> <br />Be <br /> <br />I remind the Commissio~ i;hat a variance may be permitted if all the <br />following requirements~ are met: <br /> <br />a. literal enforcement of the ordinance would result in undue hardship <br /> with respect to the property. <br /> <br />b. such unnecessary hardship results because of circumstances unique to <br /> the property. <br /> <br />c. the variance obserYes the spirit and intent of this ordinance, produces <br /> substantial justice, and is not contrary to the public interest. <br /> <br />Enclosed is a locationi plot plan and also a construction plot plan as <br />presented by the applicant. <br /> <br />Don Greenberg of the Industrial Park is requesting a variance from the subdivision <br />ordinance to allow him to subdivide a tract of land by metes and bounds. At <br />this time I have not r, ecelved a sketch plan from Mr. Greenberg on the proposal. <br />I believe this is in a~ area that the City has granted previous requests for <br />variances and to my knowledge we do not have an overall development plan which <br />indicates street design or accesses. <br /> <br />6. Plannin,~ & Zoning Administrative Reviews <br /> <br />Typical street sections, enclosed please find a letter and copies of <br />typical street sections from City Engineer Pete Raatikka for your review <br />and subsequent action if desired. Mr. Raatikka will be at the meeting <br />and available for questions. <br /> <br />bo <br /> <br />Administrative Ass~istant Phil Nereson will review the Dickenson-Grosslein <br />road issue near Tungsten and Rivlyn Streets within the City for a general <br />consensus of the Commission. <br /> <br />c. Chairman Tom Gamec will discuss dates for agenda items. <br /> <br />d..
