Motion carried. Voting Yes: Mayor Strommen, Councilmembers Shryock, Johns, Kuzma, Riley, and Williams. Voting No: None. Absent: Councilmember LeTourneau. 7.03: Consider Adoption of Resolution #16-05-100 Regarding the Preliminary Plat for The Station: Case of D.R. Horton (Project No. 16-09) WSB Municipal Planner Maass reviewed the staff report and recommendation of the Planning Commission to approve the Preliminary Plat contingent upon the applicant revising the Preliminary Plat so as to not exceed 15 units per acre. He recommended to adopt Resolution #16-05-100 granting approval of the Preliminary Plat, contingent upon compliance with the Staff Review Letter. Mike Sole, D.R. Horton Homes, thanked the Council for allowing him to be present tonight stating that D.R. Horton has been through both good and bad economic times and are excited to be back. He stated that they respect the discussion the Planning Commission had and would like to move forward with 77 units as proposed. Councilmember Kuzma asked if the applicant would be willing to accommodate the request of the Planning Commission for 15 units per acre. Mr. Sole replied that there is a cost for public improvements and perhaps removing those four units would make the price point of the project too high for the market to support. He noted that the budget is very tight and he was uncertain of the answer. Mayor Strommen stated that it was unclear to the Planning Commission how density was calculated and noted that with the additional information that was provided she felt that the applicant would be fine with their density. City Planner Anderson stated that what is stated within the Comprehensive Plan is specific to the MUSA and stated that the interpretation of staff is that right-of-way was included in the original calculations and believed that the Commission would have been supportive of the request if they would have had that information. Mayor Strommen stated that it was because of the discussion the Planning Commission had that staff was able to find the necessary information. Councilmember Riley stated that this had been approved twice before and therefore he would support being consistent with those decisions in order to remain fair and support a healthy relationship with the developer. He noted that this would meet the density requirement and therefore the Planning Commission would most likely support this decision. He stated that it also appears that there is now a definition that can be used as the standard to move forward with density calculations. Mayor Strommen stated that perhaps staff should review the code to ensure that is consistent with the Comprehensive Plan. City Council / May 24, 2016 Page 5 of 10
