Plants <br />& Things may have committed by its recent construction of a <br />building on its sit:e. ! would like to comment on each of these <br />issues: <br /> <br />Zoning <br /> <br />The subject property Is located in the City's B-1 Business <br />District which has a:~ a permitted use Retail Business, <br />therefore, the preseat use is consistent with the property's <br />zoning~ <br /> <br />2. Setback <br /> <br />Section 170 . 01<,,I, of the City code requires a building setback <br />of 1~0 feet from the center line of a thoroughfare street <br />and/or 50 feet from the right-of-way of such a street. The <br />newest buildin~ on the site is 46 feet and 49 feet <br />respectively from the street right-of-way. <br /> <br />3. Off-Street Parkin5 <br /> <br />Section ]70.014C of the City code requires one space for each <br />200 square feet of re,ail floor space. In addition, this <br />section requires that the off-street parking be graded for <br />proper drainage and surfaced as to provide a durable and <br />dustless surface. ~o date, the City has not received a <br />parking plan from the owner. <br /> <br />4. Off-Street Load ln_~. <br /> <br />Section I70.014D of ~xe City code requires one berth of not <br />less than 50 square feet for each ~0,000 square feet of floor <br />area. ~ue exi~t£ng operation is close to ~0,000 square feet <br /> <br /> <br />
