State BuiSding Code

The City'~ building ~nspector advises me that the State
Building Code requir~s toilet facilities when a building is
u~ed for retail trad~. The new building is apparently used
for retail[ trade and it has no toilet facilities.

State Bui].ding Code

The connection betwetm the new metal building and the'
existing adjacent bu~ lding was done without a building
permit,

In my opinion, the P~!anning Co~nission should recommend
enforcement of all those items in paragraphs 2 - 7 above.

With regard to Parag~'aph ~ 1 above, it would seem that the
City could have avoided ~:he setback problem had the City'm
building inspection department paid closer attention to this
issue. I believe the on[~.y way to resolve this particular issue,
at this time, t.s to consider and grant a variance. The City's
records would at least then show that this problem has been
recognized.

I believe that, a.s h~.s been auggested, Mr. ttickman of Plant~
& Things shou[[d be invited to a Planning and Zoning Commission
meeting to diacuss the cc, de violations and hopefully work out an
amicable solution with h~m. In the event this does not work, you
may want to refer this m~tter to my office for legal action to
force compliance.
