It is <br />my opinion that this is explicit language relating to all other <br />conditional use permit requirements, and is a more efficient <br />reference rather than including the entire City Zoning Ordinance <br />in the conditional us~ permit. <br /> <br /> As you know, the ~ppl. icable ordinance requirement regarding <br />parking loi; surfaces ~tates: <br /> <br />Surfacing or drai~a~e: Off-street parking areas shall be <br />paved with a dur~te and dustless surface in conformance with <br />City Engineering ~Itandards. Such area shall be so graded and <br />drained as to disgoae of all surface water accumulation <br />satlsfactorily~ <br /> <br /> Based on the abo~a~l, anguage ! fail to see, as you contend <br />that the City is going 'beyond the original conditional use permit <br />and/or its zoning ordinance. The City Engineer, who sets the <br />City's engineering standards, has stated that the "trap rock" <br />applied b~~ your ¢liemt is not in accordance with the City's <br />engineering standardt for the pavtng of a parking area with a <br />durable d~stless surface. In addition, because of its very <br />nature, "trap rock" does not lend itself to establishing a <br />drainage pattern as ~equired by the City's ordinance above <br />cited. <br /> <br /> <br />
