City of Ramsey

15153 NOWTH£N ~lOULEVARD N.W,, RAMSE¥o MINNESOTA 65303 · {612} 427-1410

WILLIAM K. GOODRICH, CITY A'I'I'ORNE~'

,'~anuary 8, 1987

Ronald O. W, Ylitalo
Attorney at Law
2472 East Seventh Avem~e
North St. Paul, ~-~ 55~09

Re: Gerald Root Conditional Use Permit/City of Ramsey

Dear Mro Ylitalo:

This letter is in ?eaponse to your letter dated December 9,
1986, addressed to the City of Ramsey relating to the above
subject.

Contrary to your s~a~ement that there is no mention of the
parking lot surfacing i~ the conditional use permit, I refer you
to the last paragraph of the conditional use permit which states
". . o amy violation ef any other City ordinances may be cause
for immediate revocation of this conditional use permit." It is
my opinion that this is explicit language relating to all other
conditional use permit requirements, and is a more efficient
reference rather than including the entire City Zoning Ordinance
in the conditional us~ permit.

As you know, the ~ppl. icable ordinance requirement regarding
parking loi; surfaces ~tates:

Surfacing or drai~a~e: Off-street parking areas shall be
paved with a dur~te and dustless surface in conformance with
City Engineering ~Itandards. Such area shall be so graded and
drained as to disgoae of all surface water accumulation
satlsfactorily~

Based on the abo~a~l, anguage ! fail to see, as you contend
that the City is going 'beyond the original conditional use permit
and/or its zoning ordinance. The City Engineer, who sets the
City's engineering standards, has stated that the "trap rock"
applied b~~ your ¢liemt is not in accordance with the City's
engineering standardt for the pavtng of a parking area with a
durable d~stless surface. In addition, because of its very
nature, "trap rock" does not lend itself to establishing a
drainage pattern as ~equired by the City's ordinance above
cited.
