B-4045 <br /> <br /> It would be rea~.onable for the City to consider some- <br />thing of the nature of hi'rap" rock to suffice as a "dustless" <br />surface. Something of tna~ nature must have been in mind when <br />the ordinance was drafted,. Obviously, "Class 5" would not be a <br />dustless surface, but it seems to us that a decorative stone, <br />rock, or gravel type of surfacing would be considered "dust- <br />less." Otherwise, the (,rdinance has perverse meaning; and we <br />cannot believe that to be true. Then, is not the "trap" rock <br />adaquate? <br /> <br /> Perhaps it is a matter of there not being enough "trap" <br />rock applied; and perhaps what was applied should be graded <br />differently. In any eveat~ it certainly appears to us that the <br />City should not demand blacktop or concrete surfacing by Mr. <br />Root, when it's ordina~,ces do not require that. No City can <br />legislate in an arbit:~:ary manner so as to require of one <br />individual what is not ~equired of all others in the community. <br /> <br /> Mr. Root is a sole proprietor who has but limited <br />means, an(] it is not easy for him to pay for parking lot <br />resurfacing that seems unnecessary. It is even more difficult <br />for him to presently find the funds with which to post the <br />bond of $3,500. Why is it necessary for him to do so at this <br />time? The construction cannot take place until next spring. Is <br />the $3,500 considered ~o be in the nature of a penalty? Does <br />the City of Ramsey wis)~ ~o discourage Mr. Root from operating <br />his business? <br /> <br /> We sincerely ho]~e that the City might further review <br />this matter.
