Norris <br /> <br />IN RE: <br /> <br />Root Business <br />Conditional Use Permit <br />Our File No. B-4045 <br /> <br />Dear Ms. Norris: <br /> <br /> Thank you for p~oviding us with copies of the pertinent <br />sections of the zoning ordinances, together with a copy of Mr. <br />Root's Conditional Use ~'ermit Agreement. <br /> <br /> There was no mention about parking lot surfacing in his <br />Conditional Use Permit Agreement, which was quite explicit <br />otherwise. Moreover~ neither the zoning ordinance in effect at <br />the time he obtained his Conditional Use Permit on May 27, <br />1986, or the new zonin~ ordinance, effective August 25, 1986, <br />require blacktop or c¢~ncrete. It, therefore, seems that the <br />City is going beyond the original Conditional Use Permit, and <br />also going beyond the r(.quirements of its zoning ordinance. <br /> <br /> We wonder why tt~i.s should be necessary. There has been <br />no problem with dust° M~'o Root is struggling to establish a <br />business, and he has been doing his best to comply with all of <br />the requests{ of the City of Ramsey. It is our understanding <br />that the City does n~t J.n any way object to his business <br />operations at this point~ and that it is a matter of simply <br />the specific surface of his parking lot. This was first <br />brought up quite recently, after we thought everything had <br />been resolw~d to the satisfaction of the City. It is a new <br />requirement~ <br /> <br /> Presumably the z)nJ.n9 ordinance is meaningful in stating <br />that the pa~cking area ~:an be a "durable and dustless surface," <br />which we understand car~ be other than blacktop or concrete. If <br />so, what can it be then? (If it could not be anything other <br />than blacktop or con{:rete~ we would expect that it would <br />specify "blacktop or co~c~'ete~") <br /> <br /> Has it been determined that the "trap" rock surfacing <br />that Mr~ Root applied would not be satisfactory under any <br />circumstances? If the ~'t~ap" rock would not create a dustless <br />surface then what would, other than asphalt or concrete? <br /> <br />?! <br /> <br /> <br />
