Mayor Gamec: aye <br /> <br />P50 <br /> <br />Motion carried. <br /> <br />Case #13: <br /> <br />Receive Bids and Award Contract for Improvement.Project #03-29, MSA <br />Streets in Ramsey Town Center <br /> <br />Assistant Public Works Director Olson stated bids were opened on April 21, 2004 for <br />Improvement Project #03-29. Nine bids were received and ranged from $4,668,665.93 to <br />$5,211,942.70. The low bid of $4,668,665.93 was from Glenn Rehbein Excavating. As part of <br />the Master Development Agreement for the Rarnsey Town Center, this is a major portion of the <br />City Phase I Construction that will be partially assessed to the RTC. Since it is an assessment <br />project, a petition from the property owners that will be assessed for this improvement will be <br />necessary as well as a Feasibility Study that needs to be prepared. <br /> <br />Assistant Public Works Director Olson advised the City is not obligated to issue the bonds or <br />commence construction of the Phase I Roadway Improvements until the requirements in Section <br />7.2 of the Master Development Agreement are met. There have been a number of issues related <br />to the Developer's letter of credit. Staff's recommendation is to go forward with the contract' <br />contingent upon the Phase I Landscape Plan submittal and staff approval, with the following <br />con'ection to paragraph one in the proposed resolution to state ".... satisfaction to be determined <br />by the City Administrator and City Attorney." He noted he will provide recommendations to the <br />City Administrator. <br /> <br />Assistant Public Works Director Olson advised staff expects to receive more information within <br />the next 1-½ weeks,' as well as an insurance letter that states any letter of credit that gets updated <br />will not be released until this amount is taken into account. He advised the information supplied <br />to the Council at the worksession on Tuesday has not substantially changed. <br /> <br />Councilmember Kurak inquired if there will be any problems with the construction season and <br />the time frame. <br /> <br />Assistant Public Works Director Olson responded in the negative. He explained this can be <br />completed even if it needs to be delayed a couple of weeks. The City has until May 31 ~t <br />according to the Master Development A~eement to commence construction and they are about <br />1-½ months ahead of schedule. <br /> <br />City Attorney Goodrich advised the developer still has three major obligations, as indicated in <br />the case, to perform prior to the May 31 st date. <br /> <br />Councilmember Cook clarified the bid can be awarded contingent on the three obligations being <br />completed. <br /> <br />Assistant Public Works Director Olson replied the notice of awards will not go out until these <br />contingencies have been accomplished. <br /> <br />City Attorney Goodrich explained the City Adn-finistrator will make the decision with input from <br />him, but these are very specific things that must be completed as specified in the contract. <br /> <br />City Council/April 27, 2004 <br /> Page 28 of 33 <br /> <br /> <br />
