AND RYLAND HOMES <br />By: Megan Wald, Associate Planner <br /> <br />Background: <br /> <br />Thc City Council approved the pr¢ii~n;rmry plat and site plan for Rivenwick Village on April 13, <br />2004. Subsequent to City Council ~'cview of the preliminary plat, the applicant, became aware of <br />a situation where the preliminary l>lat required revising. Many years ago a truck and gas station <br />was located along the north of Tru~k l[ighway 10. During extensive environmental testing of the <br />subject property, it was discovered that a small portion of the property contains a plume of gas, <br />which is a direct ~'csult fi:om thc g:tsoiine tanks leaking across Trunk Highway 10 to the subject <br />property, q'hcrt: a~'c m-mitigation mct~sures that can be taken to address the existing plume to <br />allow fi0r residcntial or commercial development to occur. However, Ryland Homes made the <br />decision not to construct residcntiai urfits on the property where the plume is located at this time. <br />As a result of R?and Homes rcm;~ving thc northeast phase of the project, the preliminary plat <br />has been rcvi,scd a~ad requires City ~' ~ouncil review and approval. <br /> <br />Thc following items are enclosed for your review: <br /> <br />a) <br />b) <br />c) <br />c) <br /> <br />Site location map <br />Revised Preliminary P/at <br />Prell minary Plat Re~ol u lion <br />City Staff Review; L,:tt¢i' dated June 4, 2004 <br /> <br />Notification: <br /> <br />In accordance with State Statute ~nd City Code residents within 700 feet were notified of the <br />prelimim~ry plat and a public hea~'ir~g was held at the March 8, 2004 Planning Commission <br />mceting. <br /> <br />Observations: <br /> <br />The applicam, st~bmitted a revi;ed preliminary plat that includes 140 town.house and <br />condominium unit:~ along with Outlot It, Outlot A, and Lot 1, Block 4. Outlot B is what has been <br />removed from tht: plat. it is staffs understanding that the future development for Outlot B will <br />most likely consist o'f commercial v:;es. It should be mentioned that future development of Outlot <br />13 will require detailed attention to ~'e--mitigation measures to ensure that environmental concerns <br />are addressed and appropriate devei~)prnent occurs. <br /> <br />The original prcli:ninary plat prol-,Os;cd to construct a total of 195 heritage town homes and <br />carriage condominiums. The revise,,l preliminary plat is proposing to develop 140 townhouse and' <br />condominium trait:; and uet dcnsit./ has been established at 7.62 units per acre. The prOPosed <br />density I'br thc sul2icct project is wi[ hi n the density criteria of 7 to 15 units per acre established in <br />the R-3 District. <br /> <br />Thc revised preli~ninary plat and site are requesting the same setback deviations that were <br />approved as part of thc original p,'eliminary plat.
