It is stafi(s ttnders~at~ding that the applicant is requesting such language be included-in
thc development agreement due to tl~e fact that the City Council is scheduled to adopt an ordinance on
June 8tI' requiring multi-family stt'ucmre~; to install fire sprinkler systems. It is staff's opinion that the
e['fcctive ¢tat¢ <)l~ the fire sprinkler ord inance and the issue of whether or not Rivenwick Village should be
subject t~ the ordinance should be a~tdrcssed when the City Council discusses the adoption of the fire
sprinkler ordinance trod not during fi~ai plat approval. Furthermore, it is not in the City's best interest to
include hmguago il~ Development A}ireements exempting subdivisions and developers from complying
with ordhlances that the City adopts stJbs~:quent to final plat approval.

Recom m e nd'.~tion:

Thc Ihml plat cem~plies with City standat'ds related to lot sizes, density, street design, and conforms to the
setback deviations approved as part ~>f the site plan and preliminary plat.
