Chartc,~r School site until (~c~ober 15, 2004 and adopt a resolution declaring the terms of <br />tiao permit, witl~ tln(; Following additiom~l conditions: <br /> <br />1. That no~ loses than 130 parki.% stalls are available on improved streets or a combination of <br /> improved si rccts and az temp~)rary parking surface finished with Class 5 materials. <br />2. ~l'hat a partial occupancy per,nit be received from the City Building Inspector for access to <br /> tine portions.. 'l'he 2(i01 Comprehensive Plan now shows the property located at <br />9150 l liglnway 10 as lx)w Density Iq esidential. Patrick Fitzpatrick resides on the subject property <br />and rcccntly bccan-~c aware of the 9arcel's residential land use designation. He indicated Mr. <br />Fitzpatrick docs m~t agree with thc residential designation and is requesting a comprehensive <br />plan amendment to change tlne land us~; designation from Low Density Residential to Places to <br />Shop. <br /> <br />Assistant COIDI'iiLIn} [y l)evelopment Di rector Trudgeon noted that the City Council has expressed <br />that they xvant lifts i>ropcrty to rema in residential, and Staff has received three letters opposed to <br />the rczoning request. <br /> <br />Citizen Input <br /> <br />Pat Fitzpatrick stat(,¢l he is asking f(r mixed use, not just B-2. He indicated he has aerial photos <br />that show how this; lays om. lie s;ated since filling out the application he has spoken with a <br />realtor and believes mixed use is tllt~ best zoning. He indicated the letters of opposition say they <br />do not want a business there, and i~e can understand that. He commented the owner at 9340 <br />wanled mixed use ~md was granted ;t and not charged for the change.
