OWNER'S RESPONSIBILITIES The OWNER'S responsibilities shMt be as set forth in Article 8 of the General Provisions and as further described or clarified herei~below: Designate one individual ti> act as the OWNER'S representative with respect to the work to be performed, and such ~erson shall have complete authority to transmit instructions, receive in:~ormation, interpret ~md define policies, and make decisions with respect to critical elements pertinent ~o the Project. Provide 'F~LDA with acces,~ to the site as required to perform services listed in SECTION II above~ Provide reviews of materiais flirnished by TKDA in a reasonable and prompt manner so that the P~oject schedule cvn be maintained. Provide TKDA with electronic basemapping including inplace topographic features, inplace groundliue DTM, i~place public utilities, and inplace right-of-way. Provide rI'KDA with location and elevation information for stormwater ponds that will accept the Project'.~: storm (irainage. Provide TKDA with Prelin dnary Layout on which the proposed design will be based (provided to TKDA o~ Ma/i0, 2004). V, PERIOD OF SERVICE We would expect to start our servia:es approximately February 1, 2005, with an assumed Project duration of 13 months. We will complete all SECTION II services by June 1, 2006. COMPENSATION Compensation to TKDA for servic~:s provided as described in SECTION II of this Proposal shall be on an Hourly Rate basis as described in Article 3 of the attached General Provisions in an amount not to ~':xceed $250,200. Our detailed Project Fee Estimate and current Hourly Rate Schedule are attached. The level of effort required to acco~.nphsh SECTION II services can be affected by factors which are beyond our control. Therefore, if it appears at any time that charges for services rendered under SECTION II will t, xceed the above, we agree that we will not perform services or incur costs whi~:h will result m billings in excess of such amount until we have been advised by you that additional funds are av~,.ilable and our work can proceed.
