Federal Aviation Regukation (FAR) Part 77.11 further requires the <br />applicant to file a n~tJce of proposed construction for FAA <br />airspace r~view. Unt;~l such time that the FAA has reviewed and <br />commented .~favorably (~nlikeiy) on the proposed continuation of <br />landfill ac~tivities, any concurring permit action by the City may <br />jeopardize federal co.~t sharing funds on the airport· <br /> <br />The city Council £irsl ~'~;~st be cognizant that two separate sets <br />of criteria govern th~ closure and ultimate end use of the <br />existing landfill~ TLe first set is that which deals with <br />current or(~inances an~ ~egulations at the County and State <br />levels. Of perhaps g~eater significance are those conditions and <br />restrictio~s that may be placed on the site due to its being <br />identified as a ~ate superfund site. <br /> <br />An Environ~ental ~£mpact Statement (EIS) is presently being pre- <br />pared on the vertical expansion application and a Remedial <br />Investigate:on (Ri) has recently been completed. A feasibility <br />study will be undertaken addressing specific findings of the RI <br />and will identify mitigative measures~ No final decision on the <br />vertical expansion sho~lid be made by the City until these studies <br />have been completed. '~o make a vertical expansion decision prior <br />to completion of the Remedial Investigation Alternative <br />Feasibility Study and/or EIS would seem to violate the very <br />purpose of the process which is to gain environmental facts in <br />order to h~ve relevant information available on the expansion <br />application° <br /> <br />II WMMI PROPOSED <br /> <br />The proposal by W/~I c~n~:.ains the following specific proposal <br />committments: <br /> <br />1. Instal]~ clay cap ,~n completed landfill. <br /> <br />e <br /> <br />Instalk groundwat~~ extraction and treatment system (or <br />other acceptable ~nvironmental controls). <br /> <br />Develop 10acre s.i.e~ding or ski area on the northeast slope <br />of landfill~ within one year of landfill completion subject <br />to agency(s) appr~v~ls, <br /> <br />4. Dedicate road rig}%t~of-way in north soil borrow area. <br /> <br />5. Sponsor annual cl~an-Up..day duringoperational period. <br /> <br />The following comments are Offered relating to each of the above: <br /> <br />Items a. an~ b. are li]:ely to be required of WMMI whether or not <br />city allows vertical e~-~ansion. .. <br /> <br /> <br />
