PERTAINS TO CASE #10 <br /> <br />PaOPOSED FINDINGS OF FACT <br /> ~ONDITIONAL USE PERMIT <br /> L & G REttBEIN, INC. <br /> CITY OF RAMSEY <br /> ANOKA COUNTY <br /> <br />1. That 1, & G Rehbeim, In:. and North Fork, Inc., hereinafter referred to <br />as "Applicant", has property applied for a grading and excavating permit to <br />create a man-made lake in ~he Northfork P.U.D. <br /> <br />2. That the Applicant appeared before the Planning and Zoning Commission <br />for a public hearing pursuant to Section 170.013D of the City Code on March <br />3, 1987 and that said public hearing was properly advertised and minutes of <br />that public hearing are heceby incorporated by reference. <br /> <br />3. That l:he subject propeuty is legally described as follows: <br /> <br />Theft part of Out~.ot C of Northfork located in the south <br />half of Section (8 and the north half of Section 19, <br />Township 32, Rankle 25, Anoka County, Minnesota, except <br />that part locate:t on the east side of Andrie Street. <br /> <br />4. That the Applicant is proposing to create a man-made lake south of <br />161st Avenue N.W. and west cf Andrie Street lq.W. in the Northfork Planned <br />Unit Develop~ent. <br /> <br />5. The proposed lake will have a surface area of approximately 40 acres <br />and an average depth of 25 feet. <br /> <br />6. That thc creation of ~'he proposed lake will take between 3 and 5 <br />years. <br /> <br />7. That the subject prope~:ty is located in the Planned Unit Development <br />District of t~he City and g~'ading and excavating are not permitted uses in <br />this distric~ . <br /> <br />8. That the adjoining laud to the northeast and west of the subject <br />property is residentially zoned and/or used. The property to the south of <br />the subject property is zoned for commercial development. <br /> <br />9. That there have been no other conditional use permits issued by the <br />City for grading and excavating to create man-made lakes. <br /> <br />10. That approximately 2,000~000 yards of material will be excavated to <br />create the l~ke. <br /> <br />11. That the majority of ~he material excavated will be hauled off the <br />subject prop(':rty. <br /> <br />12. That material shall om~.y be hauled on State, County or Municipal State <br />Aid road~ cot~$tructed to 9 ton standards. <br /> <br /> <br />
