No build up of fill material shall be permitted on 153rd Avenue N.W., Coo~nty Road 83 or (.9~ Highway 10 & 169 and in the event build up does occur, L & G RehbeJn Rinc. and North Fork, Inc. will be responsible for any costs incurred in removal of the same. If it is not possible to co~:trol the dust on any given day, the grading and excavating operati(~n shall cease on that day. This guarantee shall a.~sure the City that the proposed lake will be complected as shown or~ plans submitted, attached hereto as Exhibit "A". Said escrow is no! be released until the man-made lake is finally compl(.~ted. A mon:~.toring we'll s*~a31 be installed by L & G Rehbein Inc. and North Fork~ Inc. according to the specifications of the Department of Natural Resonrces for the purposes of monitoring the water levels in the man-made lake and Lake Itasca. L & G Rehbein Inc. and North Fork, Inc. accepts responsibility for any effect the grading and excavating may have on Lake Itasca. L & G Rehbein Inc. and. North Fork, Inc. agree to indemnify and hold harmless the City of Ramsey from any and all causes of action which might arise or be related in any way to the excavation and mining of the m~n-made lake sad/or the existence of said man-made lake. Hauli~g materials ~cross the railroad crossing at County Road 83 shall be in accordance with. any specifications of the Anoka County Highway Department and any other appropriate agency.
