PERTAINS TO CASE ~10 DRAFT CITY OF KAMSEY CONDITIONAL USE PEP. MIT GRADING AND EXCAVATING Lo & G. R:~BEIN INC. AND NORTH FOP, K, INC. On April __~ 1987 a conditia~al use permit was issued to L. & G. Rehbein Inc. and North Fork, Inc, for the grading and excavation of fill in the Northfork P.U.D. The property to be graded and excavated is located south of 161st Avenue N.W. and west of An4rie Street N.Wo The intent of the grading and excavating is to create a ma~-made lake with approximately 40 acres of surface area and an average depth of 25 feet. This grading and excavating permit shall apply to that property legali, y described as follows: That part of Outl~,t C of Northfork located in the South Half of Section 18 and the ~'~orth Half of Section 19, Township 32, Range 25, Anoka County, Minne~ota, except that part located on the east side of Andri~'~ Street. This permit is issued pursuaat to Section 170.013D of the Ramsey City Code. This conditional use permit is perpetual in its duration so long as the conditions imposed herein ar~ complied with. The conditions of this permit are as follows: A phase, lng plan and :estoration plan shall be provided and followed to minimize wind and w~ter erosion of the site and which plan shall not allow for more than five acres of shoreland to be exposed at any one time. The five acr~s of exposed area shall be exclusive of the beach area and water s~rface. Said plans are attached hereto and incorporated herein as Exhibit A. Restoration as used herein shall be defined as meaning ..Irading and top soil replacement and grass seeding such ~hat turf is established which will prevent water and wind erosicn~ No ha~ling shall ] e allowed on any residential streets including Jarvis Street and A~drie Street. Only State, County and Municipal State Aid Streets c~nstructed to 9 ton standards shall be used as haul roads° All hauling vehicles crossing the railroad tracks are required to stop before crossing the railroad tracks unless there is a full clear zone between ~:he railroad tracks and Highway 10. 3. All f~nal slopes sh,.,~ll be :Less than four feet horizontal to one foot vertical (4:1). The hours of the gr.~ding and excavating operation shall be limited to the following: ~.onday through Saturday: 6:00 a.m. to 10:00 p.m. No more than 5 acre~ of shoreland area shall be graded and excavated at any one time and the remainder of the site excluding the lake and beach shall be compi~.eted restored before commencing any new operations on the site. L & G Rehbein Inc. and North Fork, Inc. shall notify ~ity staff for insp~ction of the site prior to commencing operations · n a new area on th,~ site.
