That L & G Rehbein, I~co~ hereinafter referred to as "Applicant", has <br />properly applied for a gr~di~E and excavating per. it to create a amn-~ade <br />lake in the Northfork P,U,D, <br /> <br />2. That the Applicant apl~ea~ed before the Planning and Zoning Commission <br />for a public hearing pursuant to Section 170o013D of the City Code on March <br />3, 1987 and ~hat said pub],ic hearin~ was properly advertised and minutes of <br />that public hearing are h~reby incorporated by reference. <br /> <br />3. That the subjecf: property is legally described as follows: <br /> <br />That part of Out lo~ C of Horthfork located in the south <br />half of Section 18 and the north half of Section 19, <br />Township 32, Rm:ge 25~ An,ks County, Minnesota, except <br />that area locat~d on the east side of Andrie Street. <br /> <br />4. That the Applicant is proposing to create a man-made lake south of <br />161st Avenue N,W. and wes! of Andrie Street N.W. in the Rorthfork Planned <br />Unit DeveloD.~ento <br /> <br />5. The proposed lake wilt have a surface area of approximately 40 acres <br />and an average depth of 2~ feet, <br /> <br />6. That the creation of the proposed lake will take between 3 and 5 <br />years. <br /> <br />7. That the subjec~ propiri;y is located in the Planned Unit Development <br />District and grading and ~xcavating are not permitted uses in this <br />district ~ <br /> <br />8. That the adjoining lard ~o the northeast and west is residentially <br />zoned and/or used. The p~op~rty to the south is zoned for commercial <br />development. <br /> <br />9. That 'there have been ~o other conditional use permits issued by the <br />City for grading and excavating to create man-made lakes. <br /> <br />10. That approximately 2,000~000 yards of material will be excavated to <br />create the lake. <br /> <br />Il. That the majority of the material excavated will be hauled off the <br />subject property, <br /> <br />12. That material shall o~i.y be hauled on State, County or Municipal State <br />Aid roads constructed to 9 ton standards. <br /> <br />13, That the Applican~ is proposing to haul materials with belly dump <br />trucks which range in length from 53 feet to ~7 feet. <br /> <br /> <br />
