MEMORANDUM <br /> <br />TO: <br /> <br />Willia~n Goodrich and City of Ramsey <br /> <br />FROM: Thomas M. Fitzpatrick, Assistant Ramsey City Attorney <br /> <br />RE: <br /> <br />Recent Prosecutions ~,t Dayton Port Scale <br /> <br />DATE: April i6~ 1987 <br /> <br />Beginning on 3anuary 1, 1987, ~he Minnesota State Highway Patrol has increased <br />its activity at the Dayton Pc~rt Truck Scale located in the City of Ramsey. This <br />increase in activity is due to a delay in the openning of a new truck scale in the <br />southern metro area. Because it was assumed the new scale would open by January <br />1, additional personnel ware e;nployed. Because of the delay all of the new personnel <br />has now been temporarily assigned to the Dayton Port Scale. This has resulted in <br />almost daily activity at this scale. It is expected that this activity will continue <br />until 3une 1, 1997~ which is th~ anticipated openning of the new scale. <br /> <br />This increased activity has t esulted in a large increase in criminal prosecutions <br />connected to tcuck driving ~Aolations observed by personnel at the Dayton Port <br />Scale. While this should resu!t in increased fines to the City of Ramsey it will <br />also result in i~creased legal lees necessitated by the additional prosecutions. How- <br />ever, this increase should on!y be temporary as the activity will again decrease <br />after 3une I~ 19.~7. <br /> <br />On April 9, !987, I spoke witt, the highway patrolman in charge of the Dayton Port <br />Scale. Captain Green intormed me that it was his desire that we maintain a vigorous <br />prosecution of ~:~ny and all cit~_tions. I have inquired of Captain Green the possibility <br />of dismissing certain minor cii:ations in order to lessen prosecution costs. However, <br />it was his opinion that all violators should be prosecuted. I am therefore taking <br />the position of going forward on the prosecutions of all alleged violations. And <br />I will also pursue formal con,plaints and warrants on any truck drivers who have <br />refused to appear on the citati~,ns issued. <br /> <br />If you have any questions or comments regarding this, please contact me. <br /> <br />TMF:mn <br /> <br /> <br />
