PROPOSED FINDINGS OF FACT <br /> CONDITIONAL USE PERMIT <br /> MR. GILBERT MENKVELD <br /> CIT~ OF RAMSE"f <br /> ANOKA COUNI~ <br /> <br />1. That Mr. Gilbert Menkveld, hereinafter referred to as "Applicant", has <br />properly applied for a conditional use permit to grade and excavate. <br /> <br />2. That the Applicant appeared before the City Council for a public <br />hearing pursuant to Section 170.013D of the City Code on May 26, 1987 and <br />that said public hearing was properly advertised and minutes of that public <br />hearing are hereby incorporated by reference. <br /> <br />3. That the subject property is legally described as'follows: <br /> <br />The Northwest Quarter of the Northeast Quarter of Section 28, <br />Township 32, Range 25, Anoka County, Minnesota. Subject to <br />easements of record. <br /> <br />-and- <br /> <br />The Northeast Quarter of the Northeast Quarter of Section 28, <br />Township 32, Range 25 (except 9450 together with an easement for <br />roadway purposes over the South 33 feet of the tract herein <br />excepted (Except 9500) (Except 9605), Anoka County, Minnesota. <br /> <br />4. That the Applicant is proposing to develop a planned unit development <br />consisting of 10 lots approximately locaated on the northwest 25 acres of <br />the subject property. <br /> <br />5. The Applicant is requesting a conditional use permit to grade and <br />excavate fill from the subject property. <br /> <br />6. That the grading and excavating on that portion of the site to be <br />developed as the planned unit development shall be in accordance with the <br />grading plan for Pineview Estates 2nd Addition. <br /> <br />7. The proposed grading and excavating will occur from May 27, 1987 to <br /> <br />8. That the subject property is located in the I-1 Industrial district of <br />the City and grading and excavating are not permitted uses in this <br />district. <br /> <br />9. That the adjoining land to the north of the subject property is <br />residentially zoned and/or used. The property to the south of the subject <br />property is zoned for industrial development. <br /> <br />10. That some of the material excavated will be hauled off the subject <br />property. <br /> <br />1I. That material shall only be hauled on State, County or Municipal State <br />Aid roads constructed to 9 ton standards. <br /> <br /> <br />
