- 2 - <br /> <br />is and shall be held, transferred, sold, conveyed, used and <br /> <br />occupied subject to the covenants, conditions, restrictions, <br /> <br />easements, charges and liens hereinafter set forth. <br /> <br />" ARTICLE I <br /> <br />DEFINITIONS <br /> <br />Section 1.1 The following words, when used in this <br /> <br />Declaration (unless the context shall prohibit), shall have the <br /> <br />following meanings: <br /> <br />"Association" shall mean and refer to Pineview Estates <br />2nd Addition Association, Inc., a nonprofit corporation <br />created by Declarant under the laws of the State of <br />Minnesota for the purpose of administering and enforcing <br />on behalf of the Owners the covenants and restrictions <br />contained in this Declaration. <br /> <br />"Commerical Industrial Area" shall mean that portion of <br />the lot used to conduct business. <br /> <br />"Common Expenses" shall mean and include (i) all <br />expenses approved or incurred by the Board of Directors <br />or by officers of the Association, pursuant to authority <br />granted by the governing Documents or by law, in the <br />performance of their powers and duties and (ii) those <br />items identified as Common Expenses in the Declaration <br />and Association's Bylaws. <br /> <br />"Common Property" shall mean and refer to all real <br />property and improvements thereon owned by the <br />Association for the common use and enjoyment of the <br />Owners. HOWEVER, there is no common property to be <br />owned by the Association at the time of conveyance of <br />the first Lot. <br /> <br />"Declarant" shall mean and refer to Menkveld Co., a <br />Minnesota corporation, its successors and assigns, if <br />such successors and assigns should acquire any <br />undeveloped portions of the Property from the Declarant <br />for the purpose of Development. <br /> <br />"First Mortgagee" shall mean and refer to any person <br />named as a mortgagee under any mortgage against a lot, <br />which mortgage is first in priority upon foreclosure to <br />all other mortgages against said lot, or any successors <br />in interest to such person under said mortgage or any <br />rights arising therefrom. <br /> <br /> <br />
