payment or non-payment of any assessment relating to the Lot in <br /> <br />question. Such certificate shall be conclusive evidence of <br /> <br />payment of any assessments therein stated to have been paid. <br /> <br />Section 6.9 Non-Payment of Assessments; Liens; <br /> <br />Remedies. <br /> <br />Assessments are a personal obligation of each Owner of <br />the assessed Lot. If the assessments are not paid on <br />the due date as specified in Section 6.7, then such <br />assessments shall be delinquent and shall, together with <br />administrative charges for late payment, such interest <br />thereon and costs of collection, as hereinafter <br />provided, become a continuing lien on the Lot which <br />shall bind the Lot in the hands of the Owner, his or her <br />transferees, heirs, devisees, personal representatives <br />and assigns. The personal obligation of the Owner to <br />pay such assessment and related costs shall remain his <br />or her personal obligation and that of any of his or her <br />heirs or personal representatives. <br /> <br />If the assessment is not paid on or before the due date, <br />the Association may impose interest from the due date at <br />the highest rate allowed by law, and/or bring an action <br />at law against the Owner personally obligated to pay the <br />same or foreclose the lien by suit in the manner <br />provided for foreclosure of mortgage liens. Each Owner, <br />by acceptance of any conveyance of any interest in the <br />Property, grants to the Association a power of sale to <br />accomplish the foreclosure and sale of such Owner's Lot.. <br />In such actions the Association shall be entitled to <br />recover, in addition to the principal amount of the <br />assessments, all costs of collection, including <br />interest, attorney's fees and the costs of prosecuting <br />such action and filing any liens. In addition the <br />Association may impose an administrative charge of up <br />to 25% of the delinquent installment for each such <br />delinquent installment of assessments, and/or invoke any <br />other remedies or sanction set forth in Article XIVo <br />All remedies shall be cumulative, and the exercise of <br />one remedy shall not constitute a waiver of any other. <br /> <br />No Owner (or Occupant where applicable) may waive or <br />otherwise escape liability for any assessments or other <br />obligations imposed under the Governing Documents or <br />Rules and Regulations by non-use or waiver of any rights <br />in the Common Property or abandonment of his or her lot. <br /> <br />Section 6.10 Subordination of Lien~ to Mortgages. The lien of <br /> <br />the assessments provided for herein shall be subordinate to the <br /> <br /> <br />
